Mary Ann Elizabeth ABNEY1

F, b. circa 1829, d. after 20 March 1858
Relationship
2nd cousin 4 times removed of John Kennedy BROWN Jr.
Mary Ann Elizabeth ABNEY, daughter of Azariah ABNEY and Mary Ann POPE, was born circa 1829 in Edgefield County, South Carolina.1

She was probably the female under age 5 listed in the household of her father, Azariah ABNEY, in the 1830 Federal Census of Edgefield County, South Carolina, She would have been about 1 year old.2

She was probably the female age 10 to 15 listed in the household of her father, Azariah ABNEY, in the 1840 Federal Census of Edgefield County, South Carolina, She would have abeen about 11 years old.3

Mary Ann Elizabeth ABNEY was named an heir in the will of Azariah ABNEY dated 1843 in Edgefield, South Carolina. "Secondly, I wish that the tract of land on which I now reside containing five hundred and twenty acres more or less remain unsold with my personal property until my daughter Mary Elizabeth shall arrive at the age of twenty-one or marry...

Fourthly, I wish that the rest of my children, to wit, Augustine, Nathaniel, Azariah and Mary Elizabeth to have given and delivered to them the sum of one hundred and twenty-two dollars in property such as the rest of my children have received when they shall arrive at the age of twenty-one years or marry.

Ninthly, I wish my daughters Augustine and Mary Elizabeth remain on the place and be supported until the division shall be made or they shall marry."4

In December 1846, Mary Ann Abney petitions the Court to have David Peterson appointed her guardian. She says that she is an "infant over the age of choice - being seventeen years old," that both her parents are dead, that she is entitled to an estate but has no guardian. She is "desirous that her brother-in-law" David Peterson be appointed as her guardian. The witness for this is William S. Paterson. The paper where David Peterson agrees to be her guardian is dated January 5, 1847. The petition was filed on January 10, 1847. Note: In 1846 he says that she is 17 years old. That makes her born in 1829. The other thing interesting about this note is that her name is written as Mary Ann E. Abney. The E is marked out though in the papers twice -- once on the cover and once on the petition itself.

There is a second petition dated February 6, 1847 and says essentially the same thing that the first one says, but it it she only says that she is an infant "of the age of choice possessed and entitled to a considerable estate" and doesn't specify that she is 17. The paper where David Peterson consented to be her guardian is dated February 13, 1847. On this petition, she is simply Mary Ann Abney. There is no mention of the intital E on either the cover or in the petition itself.5

Mary married first Elijah Lake circa 1848 in Newberry County, South Carolina.

She was named an heir in the will of Elijah Lake dated 14 February 1850 in Newberry County, South Carolina. He left to his "beloved wife Mary Ann Elizabeth all my personal and real estate after my lawful debts are paid." He appointed his father, Benjamin Lake, his executor. Witnesses were John Boozer, John Mathis and Jno. F. Schumpert. It was probated 18 Feb 1850.6

She appeared in a newspaper legal posting 6 March 1858 in the The Texas Republican, published in Marshall, Texas. Estate of Azariah Abney, dec'd-- Zachariah Abney named as administrator of the estate. The heirs, who were all non-residents of the state, were: William, Hardy and Nathaniel Abney, all residents of Barbour county, Alabama; the children of Joel Abney: John, Joel, Mary Walden and her husband Caleb Walden; Mary Boozer, the sister of the deceased; and the two children of Susan Peterson, names unknown. The announcement was to run for four weeks and an estate hearing would be held at the Marshall courthouse on the last Monday of March 1858. According to a later article, the final settlement was to be made 27 Jun 1859.

Mary Ann Elizabeth ABNEY died after 20 March 1858. John Abney Chapman noted in his History of Edgefield that he never met Mad Bill or Hardy Abney, but attended the funeral of their sister, Miss Elizabeth Abney. The funeral sermon was preached by Dr. John Bolger, "a great Baptist preacher at that time" who had married a widow Wills, a sister of Azariah Abney.7

  2. [S1232] This date is an estimate based upon the context. It is NOT proven by any documentation., Her date of birth is uncertain. Her father's 1843 will said that she was until 21 which would mean she was born no earlier than 1822, however the 1820, 1830 and 1840 census suggests an earlier birth of about 1820.
