Hicks was arrested for the murder of his estranged wife, Tula Hunt, on 18 December 1944 in Autauga County, Alabama. The killing took place in downtown Prattville, before a crowd of stunned holiday shoppers. Hunt had earlier stopped and searched the car in which she usually rode to work. He then headed to town where he spotted Tula in Elmore's Five and Dime. He pursued her out of the building where a brief struggle occurred. Breaking free, his wife had run screaming up the street pursued by her husband, who caught her again in front of Red Arrow Hardware on Factory (now Main) Street. There he shot her six times with a 38-caliber pistol, killing her instantly. He was quickly captured by Sheriff Allen Stewart.

Hicks was convicted of first degree murder and sentenced to death. The sentence was later commuted to life in prison by the governor at the request of his mother and Tula's family.5
