Edward Coleman, orator, says that on October 22, 1849, William Abney mortgaged a tract of land containing 193 acres to John Coleman, who had held a promissory note for $200 plus interest. This land was on Persimmon Creek, a branch of the Little Saluda River and bounded by lands of Andrew Coleman and Joseph Griffith. There was a proviso of redemption upon payment and redemption. A copy of the note was included. John Coleman had transferred all his rights, titles, interest, and property in and over . . . to Edward Coleman, so Edward Coleman was now in possession of the note. Edward C. had asked Abney about paying it, but he had not done so. He says he believes William Abney died intestate and left a widow Abigail and children William Abney, Michael Abney, and Mary Abney. Coleman asks the Court to rule and for Court costs, etc., as well as asking that the property be sold if they do not pay. His attorney was named McGrath.
A copy of the note said that Joseph Griffith was witness to it, and that $1.00 had been paidi on it as of December 31, 1853.
On April 17, 1860, Abigail and Michael Abney were personally delivered the summons and suit, and a copy of the writ was left "at the most notorious place of residence of" the defendants Mary Abney and William Abney. Thomas Stevenson, Sheriff Lewis Jones' regular deputy, delivered the writs.
On May 26, 1860, Abigail, William, Michael, and Mary Abney responded by saying they were the living heirs of William Abney, dec'd. They also said that he also had two other children: Nancy Carter, wife of Edward Carter, and Elizabeth Goin [Goen/Gwyn], wife of Henry Goin. They said that all of them lived in the West and beyond the jurisdiction of the Edgefield court. They said that Nancy and Elizabeth were interested with William, Mary and Michael in the land described and were equally entitled to their "equity of redemption." They said they should be made parties to the bill and wanted to know what else they would need to do. They also asked for reasonable costs, etc. Abney was their solicitor. [I didn't see which Abney.]

On June 1, 1861, an order was given that since the Defendants had not answered, it was taken pro confesso, a Latin term meaning "as though confessed". In legal terms, it signifies that a claim is considered admitted, either because a party failed to respond or appear in court.
On September 12, 1862, J. Z. Carwile, said that it "appears the original order was granted by Chancellor Ingles on June 7, 1861, directing the sale of the mortgaged premises." The order was stayed by an act of the general assembly to help extend relief to debtors . . . McGrath, Edward Coleman's attorney, filed to have the order renewed, and Carwile ordered the Edgefield District to proceed with the foreclosure.
December 1, 1862: "You will please charge the land bid off to me in the case of Edward Coleman vs. Abigail Abney et. al. to Edward P. Coleman and oblige yours etc. -- John Attaway." It appears Edward P. Coleman bought the land. It is unclear whether Edward Coleman and Edward P. Coleman are the same.1
