Elizabeth married Peter Flournoy MAHONE, son of Peter MAHONE, on 28 February 1816 in Putnam County, Georgia. After her marriage, the young couple moved from Putnam county to Talbot county, Georgia in 1821, where, for six months, the family and slaves lived in temporary shelters while their land was cleared and their home built.3

Elizabeth Henry MARSHALL died on 3 June 1854 in Talbot County, Georgia, at age 54.4 She was buried in Mahone Cemetery, Belleview, Georgia.

There is a deed in Putnam county, Georgia dated 5 April 1824 in which Jesse Burt, Martha Burt, Zacheus Burt, Elizabeth Burt, James Burt, Rebecca Burt, Richard Burt and Margaret Burt, all of Putnam County, granted power of attorney to James G. Burt so that he could go to Halifax Co. and recover what was due them from "our father and father-in-law's estate, viz. Wm. Burt Senr. decd late of North Carolina, Halifax County."2

James G. BURT was named an heir in the will of Jesse BURT dated 11 August 1826 in Putnam County, Georgia.3

James G. BURT was named executor and an heir in the will of his brother-in-law, James BIGBEE, dated on 23 August 1826 in Putnam County, Georgia.4

Harris vs. James C.[G?] Burt, Edmund Butts, Richard M. Burt, J. F. Harwell and Joseph T. Burt; also 3 negroes, Shadrack, Jacob and Crecy, levied on as the property of Richard M. Burt, to satisfy executions of fi fas in favor of Joel Walker."5

James C. BURT appeared on a census, enumerated 1 October 1850, in the household of his brother-in-law Hiram READ in District 21, Macon County, Alabama. He was enumerated as J. C. Burt, a 40 year old farmer, born in Georga. Hiram had moved to Alabama about 1840 so James had probably traveled with hm. This was the time that the Indian lands were opened for settlement in east Alabama.

James married Elizabeth Jane Talbot on 8 November 1853 in Wilkes County, Georgia. The ceremony was performed by E. E. Norman, MG.6,7

James C. BURT and Elizabeth Jane Talbot appeared as head of household on a census enumerated 1 June 1860 in Southern Division, Macon County, Alabama. The household was listed as Household 543 - James C. Burt, a 50 year old farmer, born in Georgia. He had real estate valued $2500 and personal property valued $10,000. His 32 year old wife Mrs. Eliza J. Burt was also born in Georgia. Their children were Sarah R. Burt, 6; Emily M. Burt, 4; and James T. Burt, 2; all born in Alabama.

Before 1870 James C. died in Macon County, Alabama, leaving Elizabeth Jane a widow. He was buried in Creek Stand Cemetery, Creek Stand, Macon County, Alabama.

He was apparently successful as the 1860 census shows him with real estate valued at $24,000 and a personnel estate worth $12,000.

Richard M. BURT appeared as head of household on a census enumerated 9 January 1850 in District 21, Macon County, Alabama. The household was listed as R. M. Burt, a 34-year-old farmer, born in Georgia. He had real estate valued $800.6

Richard married third Eliza E. GRESHAM on 26 October 1858 in Macon County, Alabama.7

Richard M. BURT and Eliza E. GRESHAM appeared as head of household on a census enumerated 1 June 1860 in Southern Division, Macon County, Alabama. The household was listed as Richard M. Burt, a 48 year old famer, born in Georgia. He had real estate valued at $2400 and personal property valued $12000. With him was his wife Mrs. Eliza E. Burt, age 25, born in Georgia. Their children were Rebecca C. Burt, 8; Mariah Burt, 6; and James W. Burt, one month old. All the children were born in Alabama.

William, Joseph and Richard M. BURT saw military service in 1863 in Macon County, Alabama, as privates in G. B. Slaughter's company of Macon County Reserves (Home Guard). In the company were R. [Richard M.] Burt, age 50; T. J. [Joseph Tarpley] Burt, age 52 and W. [William Y.] Burt, age 55. All three were brothers and sons of James and Rebecca Burt.8

"On the first Tuesday in February next, will be sold at the courthouse in the town of Eatonton, Putnam County, within the usual hours of sale, the following property: 400 acres of land, levied on as the property of Edmund Butts, to satisfy executions of fi fas in favor of Jesse King and Sampson W. Harris vs. James C.[G?] Burt, Edmund Butts, Richard M. Burt, J. F. Harwell and Joseph T. Burt; also 3 negroes, Shadrack, Jacob and Crecy, levied on as the property of Richard M. Burt, to satisfy executions of fi fas in favor of Joel Walker."4

Joseph Tarpley BURT sold a tract of land to James Creth BURT on 24 April 1849 in Mardisville, Talladega County, Alabama, for $750. Both men were residents of Talladega County. The sale included lots 20, 21, 22, 23, 24, 25, 26, 27, 38 and 39 in Mardisville (northeast quarter of section 18, township 19, range 5). The witnesses were John Sawyer, J. W. Hardie, and Marcus M. Duncan.5 He moved from Putnam County, Georgia to Creek Stand, Macon County, Alabama, circa 1850. He developed a large plantation and moved to Auburn after the War Between the States. In the 1850 Talladega County Census he was living with the family of his cousin, James C. Burt, in Mardisville.

Joseph Tarpley BURT appeared on a census, enumerated 1 June 1850, in the household of James Creth BURT and Frances Anne GIBSON in Mardisville, Talladega County, Alabama. He was recorded as J. Tapley Burt, a farmer, age 34, born iin Georgia. He and James were cousins.6,7

This Date in Alabama History by W. J. Boles-- Between merchandising, banking, farming and fraternal associations, James Marshall Burt, native of Macon county, Alabama, led an active life during his 64 years. He was born Sept. 16, 1854, in Macon County, and died Sept. 16, 1920, in the same county, his death occurring on the anniversary of his birth.

Receiving his education in Macon County schools, he began his business career as a merchant in Opelika, branched out into agriculture, operating a farm in Lee County, and shortly prior to his death was elected chairman of the Lee County Cotton Association.

His banking connection was as a director of the Farmers National Bank of Opelika.

He was an active member of the Elks, a Democrat, member of the Opelika Kiwanis Club and steward in the Methodist Church.

Prior to their marriage his wife was Florence Bedell of Ridge Grove, near Auburn. They were married June 8, 1890. She was head of the Opelika chapter of the United Daughters of the Confederacy when the Confederate monument at Opelika was unveiled.

Hiram READ

M, b. 16 April 1801, d. 29 July 1882
     Hiram READ, son of Asa READ and Maria HULME, was born on 16 April 1801 in Putnam County, Georgia. He was a farmer and attorney.

Hiram married first Margaret Maria BURT, daughter of James BURT and Rebecca BURT, on 19 April 1822 in Putnam County, Georgia.1

Hiram READ was hired by James BURT to be his attorney on 5 November 1823 in Putnam County, Georgia. He was retained to collect debts from the legal representatives of John Mathews, dec'd of Autauga county, Alabama. Mathews was the brother-in-law of James Burt by marriage to his sister, Mary Burt. John Mathews died in January of 1822.2,3

Hiram READ was named an executor in the will of Jesse BURT dated on 11 August 1826 in Putnam County, Georgia.4

Hiram READ was named an executor in the will of James BURT dated 14 May 1829 in Putnam County, Georgia.5

By 1830, Hiram had moved from Putnam County, Georgia to Harris County. He appears on the census. He was in the 1832 gold lottery from Harris County, along with David Read (an attorney). He apparently moved to Muscogee County, Georgia for the 1840 census. David appears on the 1840 and 1850 censuses for Harris County. Hiram appears on the 1850 census for Macon County, Alabama with wife, Elizabeth. Following the Civil War, the border of Macon County changed, and the town where Hiram Read and family lived (Auburn) became part of what is now Lee County. At one time he operated Wright's Grist Mill near Auburn.

Hiram married second Elizabeth George WILLIS on 10 February 1830 in Talbot County, Georgia. The ceremony was performed by Thomas C. Medwell, JP.

Hiram READ and Elizabeth George WILLIS appeared as head of household on a census enumerated 1 October 1850 in District 21, Macon County, Alabama. The household was listed as Hiram Reed, a 49 year old farmer, born North Carolina. He had read estate valued $2000. His 38 year old wife Elizabeth Reed was born in Georgia. Their children were Emily, 20, GA; Susan, 15, GA; Andrew, 13, GA; Sarah, 11, GA; Ann, 9, AL; and Emma, 6, AL. Also in the household were Jordan Baker a 27 year old farmer, born Georgia; and J. C. Burt, a 40 year old farmer, born Georgia. James C. Burt was a brother of Hiram's first wife Maria. Based on this they appear to have migrated from Georgia to Alabama about 1840. That would be the time when all the Indian lands were opened ito settlement in east Alabama.

Hiram READ died on 29 July 1882 in Lee County, Alabama, at age 81. He was buried in Pine Hill Cemetery, Auburn, Alabama.

     John MARSHALL, son of John MARSHALL and Amelia (?), was born circa 1735 in Virginia.

John married Elizabeth BRANCH, daughter of William BRANCH Sr. and Elizabeth _____, circa 1760 in Halifax County, North Carolina.

John MARSHALL bought land from John Scowles (or Seouls) on 27 June 1774 in Halifax County, North Carolina. The deed abstract was John Scowles, planter, and Penelope his wife of Halifax Co., to John Marshall planter of the same. For 46 pounds 13 shillings 4 pence proclamation money 150 acres which said John Scowles' father James Scowles had acquired from Drury Harrington and the land came to said John from Joseph Scowles, joining John Daniel, Sr., Turkey Branch, and Samuel Jones. It was signed by John and Penelopy Seouls. Witnessed by Joseph Burt and Thomas Hines.1 He witnessed the deed of the State of North Carolina (No. 21) and Joseph BURT on 1 March 1780 in Halifax County, North Carolina.2,3

On 5 Oct 1781 John Burt and his future father-in-law, John Marshal, were witnesses to deed of land from John Hopkins to Parker Hopkins. For 2000 pounds 118.5 acres on the south side of Rockey Swamp, joining Burt, Harris, Pigpen Branch, Greens Branch, Jno. Chappep, John Worley and Hains Branch. In 1784 Joseph Burt bought 121.5 acres on the west side of Rockey Swamp from Peter Hopkins.4

John MARSHALL was included on a tax list in 1784 in District 10, Halifax County, North Carolina. He was taxed for 1200 acres, one white poll and four black polls.

John MARSHALL gifted a tract of land to Starling MARSHALL on 10 January 1797 in Halifax County, North Carolina. John left a will dated 11 February 1799 in Halifax County, North Carolina. The will probated in May 1799, left to his wife, Elizabeth Marshall, land joining Allen Marshall (where William Herbert now lives) and I lend her orchard, negroes, bed, furniture, etc. for her life or widowhood and at her death it was to be divided among his children. To his sons, Starling, he left slaves; John, slaves and "the remainder of the plantation whereon I now live and the part allotted to my wife;" Allen, slaves and the land whereon William Herbert now lives. To daughters, Lucy Jelks, Mary Moncrief, Sarah BURT, Rebecca Carroll and Sary Pitts slaves. At the death of said daughters the slaves and their increase to go the daughters' children. At the time the estate was sold the money was to go to the daugthers. Witnesses were Jesse Sturdivant and Reuben Griffis. Executors were his sons, Starling and John Marshall.5

John MARSHALL died in May 1799 in Halifax County, North Carolina.5

Living next door was his cousing William Washington Burt.1

William Marshall BURT I was listed as William Washington BURT's and Jane Ellizabeth LESEUR's neighbor in a census on 1 June 1860 in in Salem, Russell County, Alabama. Living with him was his wife, Amanda, and two sons.8

On 2 July 1860 William Marshall died in Salem, Lee County, Alabama, at age 41 leaving Amanda D. a widow.9,7 He was buried in Methodist Church Cemetery, Salem, Lee County, Alabama.

     Jesse WEAVER, son of Henry WEAVER Jr. and Abigail Gregg, was born on 8 March 1802 in Lexington District, South Carolina.1,2,3 He moved with Henry WEAVER Jr. from Lexington County, South Carolina to Tuscaloosa County, Alabama, circa 1820 It is believed that Henry, Abigail and Jesse Weaver came to Alabama about 1820 in a caravan along the old Federal Road. First settlers, known as squatters, would select the land they desired, build a house and make other improvements, while awaiting allocation of lands under the Public Lands Act. Once the surveys were completed they would buy the land they occupied, paying cash at $1.25 per acre up to 640 acres.4

Jesse married Rebecca SANFORD, daughter of William Jasper SANFORD and Barbara Rebecca SNIDER, on 12 November 1822 in Tuscaloosa County, Alabama.5 Jesse and Rebecca lived on what was known as the "Johnston's Place" on present day Keenes Mill Road at Grimes. An old cotton gin and grist mill was located between Grimes and Olmsteads Station. The old Weaver home is near Andrews Chapel. Jesse and Rebecca are buried in the Old Salem Cemetery on the Wire Road in Tuscaloosa county. Their markers are of rough fieldstone and the letters were done by hand.6

He appeared as head of household on a census enumerated 1830 in Tuscaloosa County, Alabama. The household was listed as 2 males under 5, 1 male 20-30 [Jesse], 2 females under 5 [Bethany, Barbara], 1 female 20-30 [Rebecca].7

Jesse was issued land patents for a total of 320 acres in Tuscaloosa county between 1839 and 1858. These lands were located in sections 25, 29, and 30, township 21 south, range 8 east. This is along present day Keenes Mill Road along the Bee Branch between Grimes and Coaling.6

He purchased government land patents 20 September 1839 in Cottondale, Tuscaloosa County, Alabama. He bought four lots of land on this date from the Tuscaloosa Land Office. The first three were in township 21-S, range 8-W, including 40.33 acres of northwest quarter of the northwest quarter of section 30, 80.66 acres of east half of northwest quarter of section 30, and 80.66 acres of west half of the northeast quarter of section 30. The final was 40.125 acres in the southeast quarter of the northeast quarter of section 25, township 21-S, range 9 west..8,9,10,11

Jesse WEAVER was named an executor in the will of Henry WEAVER Jr. dated 6 October 1842 in Tuscaloosa County, Alabama.

Jesse WEAVER and Rebecca SANFORD appeared as head of household on a census enumerated 1 June 1850 in Tuscaloosa County, Alabama. The household was listed as Jesse Weaver, 48, Mechanic, value of real estate $132, born South Carolina; Rebecca, 44, born South Carolina; John W., 18, born Alabama; Simon B., 16; Darkey [Dorothy], 12; Margarett B., 10; George J. H. T., 8; Dempsey J. G., 7; Esther S., 3; and Sarah J., 1 1/12. All of the children were born in Alabama. Jesse could neither read nor write.12

Jesse WEAVER was the executor and an heir of the estate of Henry WEAVER Jr. on 2 February 1857 in Tuscaloosa County, Alabama. Henry had left his estate to his wife, Sophia, during her lifetime. Since she died before the estate was settled, the terms of the will directed that the estate be divided amony the living heirs. In order to divide the estate amongst the heirs, Jesse Weaver was ordered 2 Feb 1857 to sell his father's land and property. The land where Henry had lived was discribed as the west one-half of the southeast one-quarter and the southeast one-quarter of the northeast one quarter of section 31, township 21, range 8 west. It contained 120 acres. Jesse was the highest bidder and was allowed to purchase the land 10 Mar 1857 for $2.12 per acre, or $255.13

Jesse WEAVER purchased a government land patent 1 June 1858 in Cottondale, Tuscaloosa County, Alabama. Jesse bought 80.16 acres in two parcels from the Tuscaloosa Land Office, the first being the northeast quarter of the south west quarter and the second the southeast quarter of the northwest quarter, both in section 29, township 21-S, range 8 west.14

Jesse WEAVER was listed as one of the heirs to the estate of Henry WEAVER Jr. 15 November 1858 in Tuscaloosa County, Alabama. The heirs each received a settlement of $341.07. They were listed as: Barbara Snider; Abigail Phipps; Jesse Weaver; the heirs of Elizabeth Holiman, deceased; and the heirs of Mary Lee, deceased.15

Jesse WEAVER and Rebecca SANFORD appeared as head of household on a census enumerated 1 June 1860 in Collins Beat, Tuscaloosa County, Alabama. The household was listed as Jesse Weaver, age 58, farmer, $1,000 real estate, $600 personal property, born South Carolina; Rebecca, age 55, seamtress, born South Carolina; Mary P. [Margaret], age 21; Geo. J. H. T., age 19; Daniel J. G., age 17; Elizabeth L. [Ester], 14; Sarah P., age 11; and Nancy J., age 8. All of the children were born in Alabama.16

He appeared as head of household on a state census enumerated 1866 in Tuscaloosa County, Alabama. The household was listed as one male age 10-20 [Dempsey], one male age 20-30 [George], one male age 60-70 [Jesse], two females age 10-20 [Sarah, Esther], and one female age 50-60 [Rebecca].17

Jesse WEAVER died on 26 October 1867 in Tuscaloosa County, Alabama, at age 65. He was buried in Old Salem Cemetery, Cottondale, Tuscaloosa County, Alabama.
